Privacy Policy

1. Who we are

Talechemy makes private, interactive experiences from people's photos, videos, voice notes and words.

Talechemy is operated by Tiamiyu Yusuf Ademola, trading as Talechemy, of Surulere, Lagos State, Nigeria. We are the data controller for the personal data described here, which means we decide how it is used and are responsible for it under the Nigeria Data Protection Act 2023 and the rules made under it.

2. What this policy covers

This policy covers:

  • people who visit talechemy.com;
  • people who commission an experience ("customers");
  • the people experiences are made for ("recipients");
  • anyone else who appears in material we receive.

3. If you only visit our website

Our website has no forms, does not use cookies, and does not run analytics, advertising or tracking.

Our hosting provider automatically records basic technical information when your browser requests a page, such as IP address, browser type, and the date and time. This is used only to deliver the website and protect it from abuse, and is kept by the host for a short period. We do not use it to identify you.

If you open the example experience on our website, it loads from our own demo site and collects nothing about you.

If you tap a link to WhatsApp or Instagram, you leave our website, and those services' own privacy policies apply.

4. What we collect when you commission an experience

You send us material on WhatsApp. Depending on what you choose to share, this can include:

About you: your name, phone number, the messages you send us, and records of your payments (amount, date, and the name on the transfer). We never ask for or store card numbers, PINs or bank login details.

About the recipient: their name, how you know them, photos, videos, voice notes, messages, dates, places and stories about them.

About other people: anyone else who appears in the photos, videos, messages or voice notes you send.

Sensitive information: sometimes material includes information the law treats as sensitive, such as religious beliefs (for example a prayer), health (for example in a memorial), or ethnic origin. We only use sensitive information you have chosen to send us for your experience.

We only ask for what we need. You decide what to send, and you can ask us to leave anything out or remove it.

5. What we use it for, and our legal basis

We do not sell personal data. We do not use it for advertising. We do not send you marketing messages unless you ask to receive them. We do not make decisions about anyone using automated processing that has legal or similarly significant effects.

6. Recipients and other people in your material

Most of the personal data we handle is about people who are not our customer. We protect them in these ways:

  • Customers must confirm they are entitled to share the material and that the people in it would reasonably be comfortable being included (see our Terms of Service).
  • We only use the material to make one private experience for the recipient.
  • Every experience is published at an unlisted, hard to guess link that search engines do not index.
  • Every experience includes a small link to this policy, so anyone who sees it can find out how to contact us.
  • Anyone who appears in an experience can ask us to remove material about them or to take the experience down, and we will act on it promptly.
  • We delete the original material on the schedule in section 10.

Children. If material includes anyone under 18, the customer must be their parent or guardian or have their parent's or guardian's permission. We do not knowingly accept orders from anyone under 18.

People who have died. Memorials often include people who have passed away. We treat their memory, and the privacy of their family, with the same care as anyone else's.

7. Who we share it with

We share personal data only with service providers we need to deliver the work, and only as much as they need:

  • WhatsApp (Meta Platforms), where our conversation with you takes place.
  • Netlify, Inc., which hosts our website and the finished experiences.
  • Software tools, including AI tools, that help us write, design and build experiences. Your material may be processed by these tools while we work on it. Some of these providers may, under their own terms, use content processed through their tools to improve their services.
  • Our bank, to receive payments.

These providers process data under their own terms and security measures. We may also disclose personal data if the law requires it, for example to respond to a valid court order.

8. Transfers outside Nigeria

Some of these providers store or process data outside Nigeria, including in the United States. We cannot make and host your experience without them. When you commission an experience you agree to these transfers, having been told that the countries involved may not have the same data protection laws as Nigeria. We choose established providers with recognised security and privacy protections, and we transfer only what is needed.

9. How we protect it

  • Experiences are published at unlisted links that search engines are told not to index.
  • Working files are kept on password protected devices and accounts, with two-step sign-in where available.
  • Only the owner of Talechemy handles your material.
  • We delete material on the schedule below.

No system is completely secure. If a personal data breach happens that is likely to put people at risk, we will notify the Nigeria Data Protection Commission within 72 hours of becoming aware of it, and tell the people affected without undue delay, as the law requires.

10. How long we keep it

11. Your rights

Under the Nigeria Data Protection Act you have the right to:

  • be told what personal data we hold about you and get a copy of it;
  • have inaccurate data corrected;
  • have your data deleted;
  • restrict or object to how we use it;
  • withdraw any consent you have given, at any time, without affecting what was done before;
  • receive your data in a common, machine-readable format;
  • not be subject to decisions based solely on automated processing.

These rights belong to customers, recipients and anyone who appears in material we hold. To use them, message us at hello@talechemy.com or on WhatsApp +234 806 880 2714. We may need to confirm who you are. We will respond within 30 days and there is no charge.

If you are unhappy with how we have handled your data, you can complain to the Nigeria Data Protection Commission (ndpc.gov.ng). We would appreciate the chance to put things right first.

12. Changes to this policy

If we change how we use personal data, we will update this page and the date at the top. If a change affects an order in progress, we will tell you directly before it applies to you.
